1. Agreement

By accessing or using dallitalia.com or any related service operated by Dall'Italia, LLC ("Dall'Italia," "we," "us," or "our"), you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, please do not use our website or services.

These Terms apply to:

  • Customers placing orders for products
  • Salon partners participating in our partner program
  • Anyone who contacts our concierge team by phone, SMS, email, or web form

2. Products and Services

Dall'Italia provides:

  • Salon partner programs, kits, and bundles
  • AI-assisted concierge support and customer service for inbound inquiries, appointment coordination, order-related questions, and product assistance
  • SMS, voice, and email communication channels used to support customers and partners

We may add, change, or discontinue products and services at any time without prior notice.

3. Eligibility

You must be at least 18 years old, or of legal age to enter a binding contract in your jurisdiction, to make a purchase or open an account. If you are under 18, you may use the site only with the involvement of a parent or guardian.

4. Accounts

If you create an account on dallitalia.com you are responsible for:

  • Keeping your login credentials confidential
  • All activity that occurs under your account
  • Notifying us promptly of any suspected unauthorized use

We may suspend or close accounts that violate these Terms or that present a security or fraud risk.

5. Orders, Pricing, and Payment

A. Pricing and availability. Prices, promotions, and product availability are subject to change without notice. We reserve the right to correct pricing or description errors and to cancel orders affected by them, even after an order is submitted.

B. Payment. Payment is processed through our payment providers. By placing an order you authorize us to charge the payment method you provide for the total amount of your order, including any taxes, shipping, and applicable fees.

C. Order acceptance. Receipt of an order confirmation does not guarantee acceptance. We may decline or cancel any order at our discretion, including for suspected fraud, ineligible shipping locations, pricing errors, or stock issues. If we cancel a paid order we will issue a refund.

D. Sales tax. Sales tax is added where required by law.

6. Shipping and Delivery

Shipping times are estimates and not guarantees. Risk of loss passes to you upon delivery to the carrier. You are responsible for providing accurate shipping information. Re-shipment of orders returned due to incorrect or undeliverable addresses may incur additional fees.

7. Returns, Refunds, and Cancellations

Return eligibility, timeframes, and refund handling are described on our return policy page on dallitalia.com. Some items, including opened personal care products and final sale items, may not be returnable. Contact ciao@dallitalia.com to start a return.

8. Acceptable Use

You agree not to:

  • Attempt to access another person's account
  • Reverse engineer, scrape, probe, or interfere with the site or its security
  • Send spam, scams, harassing, threatening, or abusive messages through any communication feature we provide

9. SMS, Voice, and AI Communications

A. SMS. If you provide your phone number through dallitalia.com and consent to SMS, you agree to receive text messages from Dall'Italia related to your inquiry, your order, your appointments, customer support, and concierge follow-up. Message and data rates may apply. Message frequency varies based on your activity. Reply STOP at any time to opt out, or HELP for help. Full details are in our SMS Terms.

B. Voice and call recording. Calls to or from Dall'Italia phone numbers may be answered or assisted by an AI receptionist and may be recorded or transcribed for quality, training, and support purposes where permitted by law. Where the law requires consent for recording, we will disclose recording at the start of the call.

C. AI limitations. AI-assisted responses, summaries, and recommendations may be incomplete or incorrect. You are responsible for verifying any AI-generated information before relying on it for important decisions.

D. Not for emergencies. Do not use Dall'Italia communication channels for medical, life-safety, or 911 emergencies. If you are experiencing an emergency, contact your local emergency services.

E. Consent records. We retain SMS and call consent records as required for compliance with telecom and consumer protection laws.

10. Intellectual Property

All content on dallitalia.com — including text, images, logos, product descriptions, designs, and software — is owned by Dall'Italia or its licensors and is protected by intellectual property laws. You may not copy, reproduce, modify, or distribute any of it without our written permission, except as needed to use the site for its intended purpose.

You retain ownership of content you submit (such as reviews or messages), but grant us a non-exclusive, royalty-free, worldwide license to use it in connection with operating and promoting our business.

11. User-Submitted Content

You agree that any content you submit will not be unlawful, infringing, defamatory, or harmful. We may remove user-submitted content at our discretion.

12. Third-Party Links

Our site or messages may link to third-party websites and services. We are not responsible for the content, privacy practices, or terms of any third party.

13. Disclaimer of Warranties

Products and services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, except those that cannot be disclaimed under applicable law. We do not warrant that the site will be uninterrupted, secure, or error-free, or that AI-assisted responses will be accurate.

14. Limitation of Liability

To the maximum extent permitted by law, Dall'Italia, LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site, products, or services. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

15. Indemnification

You agree to indemnify and hold harmless Dall'Italia, LLC and its affiliates from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the site or services or your violation of these Terms.

16. Termination

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
